We Proudly Assist Debtors with Collection Issues

Has your bank account been frozen because you owe an unpaid debt? Have you been served with a Citation to Discover Assets? Are you overwhelmed by excessive credit card debt?

Hipple Law P.C. has the extensive resources that you need on your side to tackle a wide variety of financial issues. Reach out to us today if you are tired of dodging phone calls from collectors looking for money.

We offer comprehensive legal guidance and representation for clients dealing with the following financial troubles:

  • Bank Levies: Judgment creditors often freeze bank accounts for weeks to collect an unpaid debt before a case is brought before the court. We have extensive experience in this area and can help you find a workable solution to resolve your financial hardship.
  • Citation to Discover: A Citation is a collection tool that requires you to appear in court and answer questions about your property and income. After you share your financial information, a creditor can try to obtain access to your property and income to pay the judgment. A Citation to Discover Assets is a very powerful tool for creditors because it not only creates a lien on all of your “non-exempt” personal property for at least six months, but it can also prohibit you from transferring or disposing of your non-exempt property.
  • Judgments: Creditors will frequently file a lawsuit to obtain a judgment. After a judgment is entered, the creditor can record the judgment as a lien against your home, seek wage garnishments, and request bank levies to freeze your checking and savings accounts.
  • Medical Debt: We have more than two decades of experience helping clients find a workable solution to resolve outstanding medical debts from a serious injury or illness. If you need assistance, please contact us today to schedule a phone, video, or office appointment to discuss your options with an attorney.
  • Payday Loans: It is easy to obtain a high interest payday or online “cash store” loan during times of financial hardship. The lender frequently require that you sign a wage assignment or bank withdrawal authorization for the loans. These types of high interest debts can be eliminated in bankruptcy as a dischargeable unsecured debt. Don’t be misled by payday lenders who tell you otherwise. By filing for bankruptcy, you can avoid high interest rates, wage assignment agreements, and aggressive payday loan collectors.
  • Foreclosure: There are options available in bankruptcy where you may be able to catch up on late payments and keep your home. A Chapter 13 bankruptcy plan allows five years to cure a mortgage default while you continue to pay your regular mortgage payments. There is also a federal automatic stay in bankruptcy that prohibits creditors from continuing mortgage collection and foreclosure proceedings during the case.
  • Wage Garnishment: When you file for bankruptcy, there is a court ordered automatic stay to stop wage garnishments immediately. You may also be able to avoid paying the garnishment creditor for an unpaid debt if you file for bankruptcy.
  • Repossession: Vehicle lenders can be some of the most aggressive and unforgiving creditors when you are late with car payments. If you need time to catch up on late payments or you cannot afford a vehicle, then bankruptcy is an option to consider. By filing for bankruptcy, you might be eligible to surrender the vehicle or repay the car loan at a lower interest rate with a court-approved plan.

Hipple Law P.C. is here to discuss the details of your unique situation and devise a customized plan to protect your hard-earned assets and make sure your wishes regarding your estate are respected.

Reach out to our firm today for qualified legal advice on any of the following estate planning matters:

  • Property Power of Attorney: This is a legal document where you can designate another person to act on your behalf and sign your name for all contract, financial, and property issues. In Illinois, the statutory nature of the power protects the individual acting on your behalf from personal liability for financial decisions they make decisions they make pursuant to the power of attorney,
  • Property of Attorney for Healthcare: This is a legal document where you can designate another person to act on your behalf to make healthcare treatment decisions if you are not able to do so because of an incapacity. The statutory nature of the power protects the individual acting on your behalf from personal liability for healthcare decisions they make per the power of attorney.
  • Living Will: A living will enables you to state specific wishes in advance of a mental incapacity about whether to extend your life by artificial means. A living will provides invaluable guidance to family members and healthcare professionals about your wishes when you are unable to communicate your decisions.
